    Friends I need an opinion regarding my wifes situation. She is currently on H4. She was on H1B before some time back which she had stamped in India itself. That H1B expired. She moved back to India. After 5 years now she applied for new H1B and got it in the quota. When the dates advanced we applied for her EAD. We were hoping to get it in 60-70 days. Now its been 75 days at TSC and no signs of approval. She had job offer based on EAD since we thought might as well use that. Now we are thinking she should get her H1B stamped because we dont know when her EAD will get approved. For that do you think going to Canada for stamping is safe. She has a Bachelors degree from India. Or do you think going to India only is thesafe option. Mainly I asked was I did some search and found out that its safest in Canada if you have US/Canadian Degree. Is that true or I am wrong and its safe for everyone. Thanks.

    Let us not shift the focus from the original question and if we do not have any answer let's sit back and let the guy face the consequences and make it an argument to prove who is wrong and right between us..

    From everything I've read before, it is safe to stay with the sponsoring employer for at least 6 mos.

    There have to be extenuating circumstances to leave earlier than that, and be prepared to elaborate during the citizenship interview.

    Citizenship is going to happen only after 5 years . But by then it would be long time gone .

    the only way that they could find out would be based on your tax return.DO they really scrutinize to that extent?

    I know I am not going to get my GC righ away by attending rallies/meetings and activity's. But there should be an efforts from every one to raise their hand and contribute for the cause. Appreciate the core members and state chapter leaders for your vision and work.

    At the same note,I regret for not being at DC after meeting some of the members yesterday.

    Before, I have little/no idea of how to approach lawmakers (my idea of meeting lawmakers was like meeting politicians in INDIA, Zindhabad...Zindhabad type), glad i do now :rolleyes:!

    Main concern/talk was about not many people turning up with 3000 IV members in the tristate, I strongly believe we can do much better in the number department for the next meeting. Again, not just numbers but with some motivation to take part in the events to come.

    I did not like the leaders thanking the members just because they turned up! It should always the other way around, members should thank the leaders for organizing such events. After all it is for ones own benefit, no one is doing a fa�vour to any one!

    Come on folks, join ur state chapters.

    I find it hard to digest why would they mind if some one has been to India recently?

    Does this argument apply just for the indians or does it apply to individual of any nationality?

    THey have eradicated malaria from north america whereas we still have it in India. They dont want us immigarants or wanna be immigrants to spread diseases!!

    I agree. I personally wud never do that. i.e Why the hell should we clean the streets of an alien bcos thier system is broken? Thats my personal opion. Didnt mean tio hurt anybody.
    Like somebody pointed out, the move shud come from employers. Again taking leave etc for a day(bandh) is the not the way. The govt shud be genuinely convinced of the cost/benefits of ramping up or increasing visa numbers inorder to make any move. We should do stuff in that direction as opposed to expressing frustration.

    I am sure most of us here (especially from India) were pampered and did not even clean their own study desks or rooms of their house when they were young, now they are ready to sweep the roads of a foreign country to get the foreign government attention to get their gc :)
    Humans, listen, life is not 1000 years, it is very short, dont waste the best part of your life waiting for gc.

    My sincere advice to the OP is to avoid posting such sensitive questions on a public board (as can be seen from the backlash by a majority of the posters).

    OP , your best bet would be to get a consultation done with an immigration lawyer. And don't worry about others labeling you as a criminal, what's done is done, the important thing is that you learn from your mistakes and never do this again. good luck.

    Thanks for 'thanking' us. :-). We don't get it much here.

    It's a well documented point that face-to-face meetings have the best chance of influencing lawmaker decisions [based on survey of Congressmen offices]. Letters come next and E-mails with addresses come the last. E-mail by anonymous senders are ignored. Hence the insistence on more face-to-face meetings.

    If you don't know it already (which I doubt), sending a large number of anonymous E-mails, and making a large number anonymous posts in any forum is considered SPAMMING. IV will never participate or encourage such SPAMMING activities which will harm it's reputation (and don't help the cause too!)

    If you think President is too busy to read our letters, why do you assume Bernanke is having all the time in the world to read anonymous E-mails and letters? He should be super-busy monitoring the BAD economic situation.

    Regarding, "EB2 (I) and world advancing" if the trend continues its a good news for many, and lesser wait times for others. However, keep in mind that the swing will reverse soon, and dates will move back once we reach the end of the year (oct). PDs will be swinging wildly back and forth , like a pendulum, from now on. But don't count on it helping you. It's like a lottery. You may get it, or miss it. Until visa numbers are increased ,a large number of us, unfortunately, will continue to be stuck in the backlog and will be motivated to participate (once we have missed it for 2-3 years, we definitely will be more appreciative and more active).

    No need to make melodramatic statements like these "people who oppose an idea(and take extra effort to shoot it down) are much worse than those who do nothing ". Nobody here is stopping you or others from doing what you deem right. We are just "suggesting" that it's not a good idea. You are free to ignore our suggestions, and do whatever you like. We too have the "freedom of expression" to make suggestions. Don't we?

    first of all a big THANKS !! for doing the above. so basically we come to the earlier point - if there are not enough dedicated members (due to laziness, family priorities etc etc) then we can try the next thing i.e. send letters / emails to whoever cares to read them and pray that something happens.
    as of now (and in my knowledge) IV is only sending letters to the President - who is obviously a busy man and maybe the letters dont even reach him.
    and hence maybe IV should start campaigns to send emails / letters to other important people (Ben, Paulson, Realtors association etc etc ) and hope that the word reaches important people.
    there is bit of urgency too ..as EB2 (I) and world start to advance ..you will get less volunteers (who take the effort to write and email)... let alone people who will take a day off to meet congressmen.
    maybe people can just send emails or post messages related to legal immigration on websites which have articles on housing, economy etc ..what is needed is leadership at top to direct people (rather than concentrating on one campaign only)
    people who oppose an idea(and take extra effort to shoot it down) are much worse than those who do nothing ..

    Could you please update your profile, like priority date, EB category etc? Is your case in TSC or NSC? Is your priority date current? what is the reason you approached congressman?
    This may give us more insight into your case.

    you mentioned, you changed job using AC21. SOC code same. Is there any salary difference?
    Is this a consulting job?

    Finally, Do not worry about denial....if the case is strong, you can always fight legally. Wait for denial letter then open MTR/appeal.

    Keep in mind that 485 eligibility is not just tied to employment but also FBI name checks etc. Do you think USCIS will keep on doing name-checks every other year, or issue EVL's every other year if/when they see for instance, an address change?


    On that point (and back to the original purpose of this thread), I called up USCIS to check on the status on my "pre-adjudication". The customer service rep asked me why I had called up when my priority date was not current (!) and I explained that it was because I had only received a fingerprint notice once and that was in Dec 2007; also it was in connection with my EAD application, as I remember it...how can this be if all applications have been preadjudicated. However, I was surprised when the customer service rep informed that my fingerprints had been updated in Mar 2009 and were valid till Mar 2010! When I mentioned that I had not gone in for any fingerprinting since Dec 2007, she even questioned whether I was saying that those were not my fingerprints and someone else had posed as me!! After that I didn't feel like disputing her anymore! She also told me that my application had been "preadjudicated". Has anyone else seen this happen??

    I am wondering if this is indicative of the fact that USCIS does not want to waste any money reprocessing fingerprints, FBI name checks etc multiple times in connection with applications that are waiting for priority dates to become current.

    I used the provisions of AC21 and changed jobs in early 2005. FOIA requests will work for your I-140. I-140 is filed by the employer on your behalf and is therefore your paperwork.
    It took approximately two and half months to come through.

    If the amnesty bill passes, you are better off pointing immigration violation and perhaps tearing you passport and claiming being illegal

    Before you tear up passport just remember that you were fingerprinted/ photoed multiple times before coming here and they can easily retrieve your records. Also if you change your names your degrees/experience will be worthless. Be careful while throwing out such comments.

    Is GC worth becoming illegal? If nothing works then leave it on fate and go back. India is not a worthless country. It gives huge oppurtunities. Sometimes I think that if westerners can go there and make money then there should be something wrong with me that I am so scared to go back.

As you may know, many of these category-based immigrant visas have not been issued over the past few years due to backlogs and processing delays at U.S. Citizenship and Immigration Services. H.R. 5882 would help prevent such losses by making available an estimated 218,000 employment-based and family-based green cards that have been unused in past years.



    In addition, Congresswoman Lofgren has introduced H.R. 5921, the "High Skilled Per Country Level Elimination Act," to remove the per country limit on employment-based immigrants. You may be aware that U.S. immigration laws limit every country to 7 percent of the worldwide level of U.S. immigrant admissions. This per-country level is established by the U.S. State Department to act as a "barrier against monopolization" and to provide fair opportunities for all skilled and professional workers from around the world. H.R. 5921 would remove per-country limits and would no longer allow unused family- or employment-based visas to be used interchangeably.



    Please know that both H.R. 5882 and H.R. 5921 are under review by the House Committee on the Judiciary. However, no companion bills have been introduced in the United States Senate. I think it is important to recognize that our immigration policies must make national security a central priority while at the same time helping to facilitate family reunification and labor demands here in the United States. I will continue to pressure Department of Homeland Security Secretary Michael Chertoff to ensure that any policy to expedite visas does not compromise our standards for accepting individuals into the United States, nor the integrity of our immigration system.     I am EB-3 India and I am just 16 years away from my Green Card. My daughter would turn 21 in 2025 and then she would be able to file for our GC under family category. Also, I would celebrate my 25 years on "temporary visa" status in 2025.
    Sorry Sunnysurya, I won't be porting my PD from 2005 to 2025. So you do not have to worry about anything.

    Remember, 245i cases were the NOT the same as the mexican illegal aliens that are being spoken of in relation to CIR .. lots of educated, legal H1-Bs lost their jobs (and their legal status) during the dot com burst of 2000 - 2002. Some of them stayed on even after going out of status, and then became eligible to file for GC under 245i.And needless to say, many more of those H1s came from India than mexico.
    There are also Non-RIR cases that were applied in apr 2001 still pending in BEC. I personallly know few of my friends whose labor is still pending in BEC with PD apr 22 , 2001.
