I asked you for the proof that 80,000 FBs are reserved for EB immigrants ( or somehow available !). You did not show me any !
There is no law that states USCIS should not consider country quotas during the last quarter. As per AC21 law USCIS should relax the quotas if the numbers are getting wasted (not already assigned to ROW). If USCIS works efficiently and assigns the visa numbers to EB3 ROW - which is retrogressed - before the end of third quarter, they don't need to relax country quotas in the fourth quarter.
In a way USCIS inefficiency is helping applicants from retrogressed countries get GCs faster (4th quarter relaxation) :).

Here is my scenario:
My first H1 was approved in 2004. But i came here in June 2005. Will my 6 year count starts from June '05 OR Oct '04 ? Pls suggest.

According to my spouse, there were three treatments at the embassy:
Passports retained for approvable/approved cases
Passports returned for rejected cases
Passports retained (no options provided to applicants) for audit cases
In your case, evidently they gave you an option as to whether you wanted to go with the delay. Am I right in assuming that?
Or were you asked to wait with your passport till they cleared up your case at their end?
We are not withdrawing our H1B application that was approved by USCIS. We are merely contemplating withdrawing from getting the actual visa stamp because of the uncertainty.
Right now, the embassy people are not being communicative at all. They did not respond to the last email we sent them and they do not have a live person taking any phone calls.
Initially they said the audit could take 4 weeks but their website (login enabled) says it might take up to 8 weeks.
The officer only said "you will hear from us when we get the clearance."
Said nothing about keeping the passport.

what happens if I had interfiled with a new I-140 EB2 (currently pending) and now my original approved I-140 EB3 became current?

Starting July 16th, 2007, labor certification has a 60 day validity period. Meaning, a I-140 petition needs to be filed within 60 days from labor approval date....If immigrant visa numbers are unavailable (dates retrogressed), you wont be able to file your I-140/I-485 concurrently but you can file your I-140 petition irrespective of your priority date as long as you have a labor approved. You dont have to apply for your labor again and again....Its just that, once you get your I-140 approved, you will have to wait for dates to become current to file I-485...

I guess this is 1st step in right direction. People with MS and PhD from US universities should be given preferential treatment.
i agree..i do not have any masters from US, but defenitely support those people who have studied here going ahead of me in the line. this is merit based..

I did the same and got 2 more people to send them and I'm hoping for 2 more. We're a small office but any letter counts :)

this is a valid point.
but advantages of CP vs AOS are completely besides the point as that decision is based on individual circumstances.
If you/IV want to lobby, lobby for EAD/AP for the guys whose 140 was approved and staying in US legally on a non-immigrant visa. This may be possible thro, USCIS regulation w/o law change.

Design and development of business applications using C++, JAVA as front end
tools and ORACLE as back end repository on WINDOWS platform. Modify
software or customize software for clients'use with the aim of optimizing
operational efficiency.
Education required: bachelor degree in computer science, engineering,
electronics or related field. Experience required: 9 months as Software
Engineer.
Any idea what Onet code the above description falls under?
I am planning to take up Java developer position with new employer using EAD. is it ok? Lawyer has been saying that the job description has to match 100%. I dont agree with him. any comments please?.

I have also observed all my H1Bs that expired 4 years and two years ago, have got soft LUDs after I used AC21.
In fact the status on my I-485 case stopped changing even when they issued RFE and FP notice. I straightaway received these notices. The status on my case has not changed for last six months, my FP happened 3 months ago. So now I get scared even if there is just LUD on any of my cases as I am not sure what is this about.
Overall AC21 has been a very tense experience for me. Please do not go that way if your original employer is a real bad guy. In my case the original employer was as bad as one could be, the laywer that new employer hired is as insensitive, arrogant and crack-pot as one could be and new employer absolutely careless.
Full one and half year has passed since I changed employer, six months since I submitted my evidence, almost four months since my second FP and I still don't know what is going to happen.
So my advise to all of you, think ten times before embarking on this risky or rather tension packed journey. There is no thrill in it.

The discussion seems to be focused on getting a certification to add to your resume. I am a PMP too, have delivered several small projects.
I think whether you are a PM or a developer, PMP is a good step to understanding and appreciating the business value of what you are doing as a techie.
It is not just a certification but a way of thinking.
It applies to everything in your life not just your work......
Treating it like a commodity isn't the best way to look at it.

I am worried if I would have any problems converting to H1 since I am practically out of work force since 2000.

I got my AP approved in approx 50 days. It was filed on 10/14/10 at NSC, mailed supporting documents within 7 days of filing it online and got approval yesterday(12/6/10) without any RFE.

Its useless... How many senators, their voters or other decision makers watch those kannada, telugu or even rediff???
Try to contact FOX, CNN, ABC etc.. that will be helpfull.
It is for all those people (the indian diaspora) who do log on to the online versions of their hometown newspapers to check local Indian news, it might be a pleasant surprise to see the news abt the rally out there!!!
Secondly won't you be inclined to be a part of the rally when your mom or dad friend or a cousin read the news back home and asked you " are you a part this movement" imagine all the non commital people saying ummm ummmm food for thought bloke!!:rolleyes:
