    Hi Shana

    If I understand your question correctly, then if you are using H1 then you need to be on payroll all the time. Does not matter whether or not using AC21. This applies even after 180 days of your AOS. If you use EAD then you can be without a job.

    Not sure what Shana wants, looks like he is feeling insecure about the whole process of changing jobs or layoffs etc....

    He wants assurance that AC21 works fine and he will not have any issues.

    I can only say - AC21 protects you, but cannot guarantee the ride will be smooth.

    This question has been bugging the HECK out of me as well. I mean the only way this makes sense is if 245(i) + EB3 for India >> 245(i) for Mexico. Now from all that i have read/heard/seen, it seems like 245(i) is the major hurdle. Then how is it that EB3 India is stuck and everyone else is moving? The above equation must mean that there is a SIGNIFICANT number of 245(i) cases from India as well. Any thoughts anyone? :confused:

    There is a general assumption that there not many 245(i) cases from Indian nationals. In reality, there are many people from India working in Grocery stores to Gas pumps applied for 245(i) during that period.

    As USCIS started looking in to the continuation of services, couple of my friends who did not worked more than 180 days land into trouble during their I-485 denied. Their attorney suggested them to take the same 245(i) route and many such tech workers are also might have fall into this category.

    I believe there may be several such 245(i) cases from India and we will be able to know the exact number of cases one and only if DOL / USCIS publish the number of cases at their end. Till then we have to live with our own prediction similar to that of visa bulletin.

    This also gives a good idea for someone to start a predication thread for 'Number of 245(i) cases for India' :)

    Nurses are part of EB. This nill has many benefits. More nurses will be out of greencard queue leaving others more chance. US has acute nurses shortage. It is well documented. There is not much shortage of IT professionals . Unemployment is so high. But nurses are in demand and it is important for the healthcare of the nation. Supporting the bill is a win win for everyone in EB wait.

    Really? Nurses are part of EB?? I was not aware of that. Which catagory EB3? EB2? Just curious. Either way i dont think the president is going to support this one.

    From everything I've read before, it is safe to stay with the sponsoring employer for at least 6 mos.

    There have to be extenuating circumstances to leave earlier than that, and be prepared to elaborate during the citizenship interview.

    Citizenship is going to happen only after 5 years . But by then it would be long time gone .

    the only way that they could find out would be based on your tax return.DO they really scrutinize to that extent?

    Figures suggest that there are over 800,000 pending applications. Recapture will get around approximately 215,000 green cards. We are shot of around 600,000 green cards, which will take around 4 years (@140k/yr EB green card) to address the current backlog, which contains your and mine application. This is a deep deep hole and EB3-I is at the bottom of this hole.

    My wife has a H1 since oct 2006 till date she hasn't worked and hence has no pay stubs. her passport has a F2 visa. I want to convert her visa to H4. Her employer is asking for 6k to generate 3 paystubs for 3 months. I dont want to pay so much. if we go to canada to get H4 stamping will they ask for her pay stubs or just my pay stubs are enough.

    Is there any chance of rejection. also can I go to canada for stamping or do i have to go to home country.

    is there any site or posting that explains the process of applying for H4 in canada.

    status change from H1 to H4 when she is in US, she need 2 latest pay stubs. If she is directly going for H4 stamping (India), then she dont need pay stubs.

    DA knows that for them to win the case, they need your wife's statement on their side. And for you to win the case your wife will have to testify under oath. The attorneys are prepared on both sides to argue this case and examine and cross examine the case. Make sure you have a really really good attorney.

    I hope you are telling the truth. If not why she didnt tell the police or you didnt tell police the real reason. Now the onus is on your wife to contact the police and DA and let them know the truth.

    Hi

    I have a question regarding an appeal I did a year ago for a rejected LC.

    I have an approved LC and I-140 on an entry level position (EB3) with my company. after I got a promotion to a senior position that requires a masters degree but with a smilar job description but more senior and supervisory responsabilities with the same company. after promotion, I filed for a new LC (EB2) but it got rejected because DOL thinks it is the same position as the already approved LC. my company and I wrote a letter as an appeal on Sep 2006 within 30 days from rejection of LC to BALCA explaining that new position requires a masters degree and it is a senior position with more supervisory duties. as of today, almost a year later, we haven't heard anything regarding DOL (BALCA) decision on my appeal. is anybody in the same situation?? what should I do next?? also I read somewhere that DOl might revoke the already approved LC EB3 after I filed a second LC for EB2 with the same employer. can DOL revoke the first LC EB3 after I have an approved I-140?? please help. Thanks

    My current EAD expires this Friday. I e-filed on May 5th. Infopass after 90 days did not help. They approved my expedite request on 19th and said I should hear something in 14 days which is another 5-6 days.

    I did contact my Senator (Cornyn) who actually offers to help with time-sensitive problems with federal agencies. This was about 2 weeks ago, even before I submitted my expedite request. I'm going to give them a call tomorrow to see if they have heard anything.

    Yesterday, I was told by the client that my project is going to end by this month end i.e Apr 30. Actually it was supposed to go for the next 2 years. I am currently in the project working for the project. They said the lay off was becoz of budget

    Sorry to hear this however you can go for COBRA. these days u can avail Obama discount as well which brings your insurance down by 60 percent so u will be pretty much paying the same what u are paying now.

    Employer has every right to terminate employee so we can't go gainst the emploer.

    Stick to COBRA..

    Looks like you forgot the intense pain of what you claim to be "agonizing 5 years" in no time. If DOL were so particular in doing things on time and keeping up their promises then it wouldn't have taken 5 years for your labor to clear. With all due respect, please stop telling us about DOL deadline...it holds no ground.

    We understand Immigration Reform Bills being discussed currently and the need to focus on them...however, only thing we (BEC victims) are trying to put across is that if someone from IV does get the opportunity to speak infront of the congress, please don't forget to highlight the BEC mess (PBEC in particular). Labor certification backlog is one big part of the whole broken immigration system. It can not be isolated. Even if it is administrative problem we need the lawmakers attention to get it fixed.



    Ladies & Gentlemen
    I can understand the emotion and commotion among my fellow beings who are stuck with BECs. I waited agonizing 5 years to get my labor cleared. We all clearly understand what are you guys going through.

    But the thing is that Labor Certification issues are taken care with PERM implementation. Also the administration set up 2 BECs to take care of them back logs. Now the issue is purely administrative and not law making. Also BECs made it clear that by Oct 2007 all the back logs will be cleared.

    Right now big things are happening in the immigration law making. So I think we should concentrate to get the best out of it and achieve our goals on the Green Card Visa issues. As Tom Tancredo is going to fight with teeth and nail against Immi Bills, we have to do the same.

    There are many others issues we can lobby for such as

    1) Starting H1B stamping inside the US again( Which was stopped in 2005)
    2) Allow H1B spouses to work. etc etc


    But I believe our priority for the time being should be Retrogression. I request all of you to use this thread for finding a person to testify.

    Your good fight on the retrogression issue kind of kept us going without giving up. In just a few days what some of you have done with www.immigrationvoice.org is amazing and it truly deserves a lot better than the faint response they have got so far from all of us in this legal black hole. Honestly, I do not care if we are not able to raise 100K dollars for the lobbying efforts for the next immigration bill on February. I don not care if this money is finally lost. It will be money well spent if we all realize that we have to do something instead of waiting years and years and years� Any money is worth the effort regarding our goals, even if our present intention does not succeed. Is worth it!!. Lets move on, hoping for the best� It is worth to try this next immigration bill. Any money spent on this is worth it� Can not you guys see it? More and more years on this black hole!! More years paying our lawyers for H1B renewal, more years for renewal of our driving licenses, more years for our wives to wait, more years for our employers exploiting us� This next immigration bill could be our last chance in many years to get our unfair and sad situation known and probably solved. We would at least raise enough concern about the absurd situation of the legal immigrants� It could be a new Quixote tale, I do not care� A good part of my next paycheck will go to immigrationvoice� Whatever� Keep America growing� America is not just them�. It is all of us� It has always been� It is what America is made of�
