Dear Members,
We have worked hard in the last 4 years and have made some progress along the way Immigration Voice Achievements (http://immigrationvoice.org/index.php?option=com_content&task=view&id=5&Itemid=47) But Most of us are still in the limbo of green card process and waiting in different stages. Some of us may have advanced to the I-485 stage and have a little more career flexibility but the hanging sword of uncertainty still looms over our heads.
Our angst, our insecurity:
Even with EAD and other options, lack of green card is lack of security and lack of certainty. You know it and you feel it every day. In order to find a permanent fix for the uncertainty, angst and insecurity and in order to snap out of the probationary lifestyle and career, we have to finish what we started over 4 years ago -- get the U.S. Congress to act on this problem and solve it once and for all.
Early effort wins:
The first agenda of next Congress will be immigration and we expect an immigration bill to be debated sometime in early 2011. However, it would be a big mistake to wait until that time to do something about that bill. Successful advocacy efforts are the ones that start early and introduce concepts and ideas into the debate before the legislators write their first draft. Once the committee hearings and debates begin, it is harder to get changes or fixes into a bill because it requires an amendment to the bill in a politically charged and heated atmosphere. Groups and organizations that wait until the last minute to influence members of congress often fail to achieve results. In order to succeed in next year's immigration bill, we have to begin talking to members of congress now. Remember, the advocacy efforts we did with lobby day and rally in Sept 2007 influenced congress to include our provisions in bipartisan bills introduced in Aug 2008. Legislative things take time.
How you can help:
You and help in two different ways:
Join the advocacy effort in DC on June 7th and 8th. (http://immigrationvoice.org/forum/forum85-action-items-for-everyone/1437978-iv-announcement-advocacy-days-in-washington-dc-7th-and-8th-june.html) If you have never done this before, we encourage you to help us with this and join us. Immigration voice will arrange the logistics of setting up meetings and arranging the material for you to take to your Congressmen and Senators. We are expecting about 150 immigration voice members to gather in DC and participate in over 200 meetings with Congressmen and Senators.
Contributing Funds to help finance the effort (http://immigrationvoice.org/forum/forum85-action-items-for-everyone/1534974-funding-drive-iv-needs-your-support-for-advocacy-events-in-dc.html). You are most welcome to come to DC and join us but if your job demands are such that you cannot take two days off on June 7th and 8th, then you can still contribute to this effort by contributing financially to Immigration Voice. Many expenses tied to the travel of grassroots members from distant states is being expensed by Immigration Voice. So kindly contribute funds to this effort by clicking on this link. You have an obligation to yourself and your family to plant your career in this country once and for all. EAD and AP, if you have them, are not going to cut it. We are not there yet. My current H1 is expiring soon. My 3 year H1 extension is pending. I had receipt notice but NJ DMV at Wayne refused to accept that. My current License is valid only till the middle of the next month.
Any body in the same boat? What shall I do?
My friend was in a similar situation last yr, He took his all his documents to Trenton DMV and they have given him 90 days extension.

Hindus could be anywhere in the world, not just India. Being a Hindu does not automatically mean you are an Indian. You could be a citizen of any country. So it does not establish the notion that it is an India centric website.
Just like all Muslims are not from Saudi Arabia. They are in 100's of different countres and citizens of diverse nations from UK and Malaysia to Australia and Germany. Christians could be from Europe, Australia and India or the African continent or China and other parts of Asia. I personally know Hindus that are from Fiji, Trinidad, Singapore, Malaysia, Sweden, UK, Canada and they are not Indian citizens.
Moreover, Diwali is for everybody, Just like X'MAS is. You can be an American and be a Hindu. So There is no question of IV getting targetted as India-centric or Indian issues-specific website.

Some more info that may help you. Once you the get exact reason for denial and if it is because of AC21 wrongful denial then file Form to Ombudsman and attach your employment letter with clear job description showing you work in same/similar classification, explaining that you fulfilled AC21 conditions and that your I-485 was wrongfully denied along with your MTR receipt (once you file MTR).
Please note this is from what I have read other posts on this board and not from my personal experience. Also IV would also be able to guide you in resolving this situation.

I disagree that the situation is very bad.
It is bad only for those that are laid off on H1B. All others have EAD and are happy. They will realize the bad situation only when they cannot take a promotion or salary raise or cannot change job due to same and similar. Or if I485 gets an RFE or denial.
If the situation was bad, more people would be serious about your idea including you. Even you are not willing to do anything yourself other than asking others to do it. So this is the fate of immigrant community. We all do not want to do anything ourselves unless we ourseves are in a bad situation.

When we conducted D.C. rally, there were roughly 1500 people attended. Each member has his/her own reason for not attending the rally.
The reasons could be, taking a day off from work or to far from their place etc..,
As a first step��..:)
Why don�t we plan for rally on the same day, same time at various major cities? This would enable members to attend in their respective cities.
We knew that, we are 25K+ members strong and can hold rallies/protests, where we have (major cities) at least 100+ members.
We must invite media and local US leader�s for rally and show our strength and request them to work towards the Green Cards.
Why don�t we plan for a rally during the this Christmas season?
The reasons could be, taking a day off from work or to far from their place etc..,

Few months back, 2 DMV officers gave me a tough time in CT. I wrote strong complaint and got a reply that, it will be allright if I go again and I went for the 3rd time and got it without hasstles.

I personally think that 6 month rule-of-thumb is nonsense.
AC21 clearly states you can switch employers 6 months after your green card application has been pending. On what legal basis could USCIS then come back and deny citizenship to anyone for switching employers too soon after getting their green card?
I'd really be interested to hear if someone has specific knowledge of a case where someone had their citizenship denied due to switching companies too soon after getting their green card.
I'm just curious as to how many postings you see on these boards where a persons case has been denied; DOL/USCIS has visited their home; their visa got cancelled by consultate when h-4 went for stamping; got caught in interview lying; DOL investigating companies, etc...
People do not post these types of issues on immigration forums.

The Employment Based Immigration section explains how they will make a task force to prevent illegal workers from being exploited. I don't see anything for legal EB workers other than this 5 year thing which will start counting after this law is passed. :mad:
It says 5 years preceding from the date this law is enacted. Does this not mean that they will look 5 years back from the date this law is enacted?
Also i do not see them say it is for illegals only...
I do not think they would make it easier for illegals than legal residents.
I am not very optimistic about this . But i would definately like to see this pass.

yes my case rejected due to number of years of education.
My case they rejected because i have 3 year Bsc and 2 year master now funny thing is that i know my friend who did similar course from same university but he did same master degree like me but in part time so he complete in 3 years and he got approval in 2009.

If the USCIS cashes the checks and then returns the packets (total $1490 in my case), is there any legal recourse to get a refund from them? Since they are pretty much doing whatever they want, this thought just occurred to me.
