in the long run, it is going to be extremely BAD/HARD for skilled immigrants..
I couldn't confirm it but from what I understand, the dual intent will no longer be valid on H1 ie A H1-B holder cannot have an immigrant intent. Does that mean, they cannot file for a GC, while on H1? Also, as consulting would be severely restricted, how many of the H1s will be able to find Full-Time Jobs?
As we read more into the Bill, the 'hidden' intent is becoming clear..
Restrictions & more Restrictions..
My dear friend this statement that you made is BS. Pls read the bill draft carefully, actually they have added dual intent to even F1 in some catagories. They have not taken dual intent off H1b visas. Our major killer is however the restrictions imposed for extension beyond 6 years. We need the employer's recomendation + >365 days pending 140. I dont know whether one of these would suffice or whether both would be needed??? Otherwise it looks not VERY bad, but bad.

The way i see it, they've asked for past emp letter with tax forms and some w2s.
None of those would indicate that you were on the bench.
The emp letter should basically just indicate your dates for employment - start/end date, designation, duties and perhaps salary. that's all.

I just wish this is true and also wish that guy burger king (a.k.a steve king) does not filibuster this tooo....
don't worry, the republican minority in the house has no power whatsoever. A simple majority(50% + 1) is what it takes to pass a bill in the house and the Dems have more than a simple majority.
Only the senators can call for a fillibuster.

good point. let's start doing it then...
just my opinion..but festive occasions bind us as a community and yes that includes Eid and Christmas and the Chinese new year.
Diwali celebrates the victory of good over evil, let's hope we can all bask soon in a festival of lights by getting some relief from retrogression....
actually...and this is just me nitpicking now...Diwali is technically a Hindu festival not an Indian festival (since 20% of Indians are not Hindu), so the complaint may be more accurate if you point to the religious aspect...
Of course it is widely celebrated in India...and the UK and going by the White house greetings and the huge melas ...in the US :-)
"Happy Diwali" to anybody on this forum who accepts the Hindu faith.
I don't think wishing Happy Diwali to fellows of a common faith qualifies as hate mongering; same as a Muslim wishing a fellow Muslim "Eid Mubarak" or a Christian wishing a fellow Chrisitian "Merry Christmas" does not qualify as hate mongering.
All said and done this is an open forum where potential immigrants to this country (where there is a long history of separation of state and religion) are free to express their opinion.
USA has certainly benefited from having different cultures live together side by side (within the realm of a common civil and criminal law). Suppression of cultures is more in tune with the ertswhile Soviet policy of suppression of various cultures (Georgian, Ukrainian, the list goes on); and we all know what happpened to Soviet Russia.
There is no reason potential legal immigrants of different faith should not open a new thread to wish people of fellow faith on commonly celebrated festivals. There is no great reason to pursue political correct speak to the degree where you would have to create a common greeting message if we want to wish "Happy Diwali" to fellow Hindus.
People of different faiths certainly have the freedom to post a similar message. After all the pool of potential legal immigrants is far and wide.
And I would certainly be happy for fellow Chinese, Muslims, Chrisitians, Buddhists, Jains, Sikhs, Native Americans, Mexicans, Portuegese, Spanish, Greeks, Albanians, Croats, Serbs, Basque, Irish, SriLankan, Bangladeshis, Eritreans, Ethiopians, Somalis, Germans, French, Bralizians, Colombian, Ecuadarean, Argentinians, Chilean, Haitians, West Indians (the list is incomplete mind you) when somebody from their community puts up a message wishing their fellows the arrival of a happy community event.
The voice of these communities is the "Voice" of "Immigration". It would be foolhardy to try to suppress this voice in favor of political correct speak.
We are all working toward the same goal (pursuit of happiness); denial of one's culture and simple traditions is not in tune with this pursuit.
Just my 2 cents.
Regards.

If America losses us, many of us are already planning to go back to India because of this GC process, they will also lose these kids who are bright future of America.
To me, more than anything, what the immigrant parents bring to the table, is the stable family life that they can provide to their children that is the best of eastern and western values. I hope this run continues and these kids excel in whatever they do.

Thank you so much for your heartfelt and spontaneous post. I knew about what these people have written, but thought it was no point getting into discussion because some of the postings seemed to be so immature.
However, just so you know, here is the background,
[a] One of the reporters of Indian Express telephoned for my comments and the flower campaign, and wanted to know what was happening. I gave him the background, and my analysis, however, it exactly happened as you put it the reporter assumed that I was one of the organizers, since I am so often involved in US-India affairs.
[b] Had I wanted to take credit, I would not have even mentioned Immigration Voice to the reporter (the reporter wrote Emigration Voice, on his own probably)
It beats common sense for me to try for credit in this matter there is too much on my plate already, and I was not at all involved in this campaign. If there was absolutely nothing I was doing, then where is the logic for me to inflate my role or ego? But yes, I have been involved as an analyst, and well wisher, of this campaign and Immigration Voice by letting so many countless people in media and politics, in the US and India know of this very fine initiative.
Also, just by the way, more than two days ago, before this Indian Express story came out, another media, NDTV had approached me to help them connect with the people in the campaign and I asked a colleague of mine to inform IV; and Aman was sent an email with the name, and contact details of the NDTV reporter in New York. Plus, the CNN-IBN reporter who covered this story (the same story / video about which many of IV people are so proud on their blogs) she was instructed by her Delhi office to follow this story only after I spoke to their international affairs editor (him and I were talking about the Lal Masjid matter in Pakistan, and then we got talking about general matters, and its then that I familiarized him of this interesting campaign happening, and he immediately sent messages so that CNN-IBN should cover this story).
In fact even before Surabhi posted on IV yesterday re this matter, at least 36 hours before that I had written an email to Aman Kapur on my own and informed him that the news report had incorrectly mentioned that I am a coordinator of the campaign. After writing to Aman I considered my duty done as any such little misunderstanding should be clarified between mature people who are in public life.
I have been in this business too long, too deep, and too wide, to know and understand that the media at times makes mistakes in its interpretations
It does feel very warm, nice, and grateful to know that you went and gave them your candid and immediate opinion. Thank you so much my friend!

I think this has been discussed on some other thread.. would it be a good idea to make the contributions public.. may be, this encourages others to contribute, when they realize how much more is needed to reach the monetary goal.
I attended recent meeting arranged by IV in Virginia and they discussed about all this info you are asking. I don't think core team can publicly disclose all this info. They even showed us the recent bill they got to pay the lobbying firm. So next time there is IV meeting please attend it and your questions will be answered in private but not in a public forum.

A lot of people seem to be saying this. It seems e-filing AP usually triggers a new FP notice. If this true then it will certainly delay things. We would be better off filing AP by paper.
What does everybody say?
I don't know if this question has been asked before. Is there a benefit for filing AP by paper rather then electronically. I filed EAD by paper to TCS and got the "Card Production Ordered" email yesterday (in 14 days) for myself and my wife. My friends who efiled just received finger printing appointment notification and no receipts. Is there same benefit with AP? Please calrify.

Shirish has a very valid point. I think it should be six months after I-485 application as pointed in AC21.
[QUOTE=shirish;147335]I think the 6 months period should be counted fron the RD on the RN for you I-485, else AC21 and this " propoganda" contadict each other.
If you get your GC with in 6months from the RD then stay untill you finish 6 months (this is very unlikely to happen as it takes lot more than 6 months)
If you get the GC after 6 months i think you are fine.

The Ombudsman agrees with the assessment of many case workers and supervisors at USCIS field offices and service centers that the FBI name check process has limited value to public safety or national security, especially because in almost every case the applicant is in the United States during the name check process, living or working without restriction.
The Ombudsman recommended in the 2006 Annual Report (at p. 25) that the FBI name check process be re-examined. Delays in the name check process actually prolong an individual’s presence in the United States while the check is pending. In this sense, the current USCIS name check policy may increase the risk to national security by extending the time a potential criminal or terrorist remains in the country.
Name checks do not differentiate whether the individual has been in the United States for many years or a few days, is from and/or has traveled frequently to a country designated as a State Sponsor of Terrorism, or is a member of the U.S. military. Many individuals subject to lengthy name checks are either already green card holders or have been issued Employment Authorization Documents (EADs). These documents allow them to receive Social Security cards and state drivers’ licenses. Most green card applicants are also eligible to receive advance parole enabling them to travel outside the United States and return as long as their cases are pending, which can be for many years under the current process. (page 43)
As Dawn Lurie, a Vienna immigration lawyer, put it: "If there's a security reason [for the delay], then what are those people still doing here? . . . And if there isn't a security reason, then why are we making them wait for so long?" (Washington Post (http://immigrationvoice.org/forum/showpost.php?p=85213&postcount=365))
FBI name checks disclose information to USCIS that is otherwise not available. Information contained in 39 [percent] of the FBI positive responses (letterhead memoranda) received in FY 06 was not contained in IBIS/TECS, USCIS’ primary background check tool. . ..
Use of the 39 percent positive response rate as referenced by USCIS to justify continuing this program may exaggerate the value of the FBI name check. It is unclear how many of the FBI name check “responses” also were revealed by one or more of the other security checks conducted for the applications. To date, the Ombudsman has been unable to ascertain from USCIS the total number of actual problem cases that the agency discovered exclusively as a result of the FBI name check. The Ombudsman understands that most, if not all, of the problem cases which would result in an eventual denial of benefits also can be revealed by the other more efficient, automated criminal and security checks that USCIS initiates.
While USCIS declined to provide the number or percentage of annual name checks that result in denials, the FBI has reported that less than 1 percent of 1.5 million names are ultimately tied to potentially damaging information.(Washington Post (http://immigrationvoice.org/forum/showpost.php?p=85213&postcount=365))

I totally agree with Arunmohan- We H4's are not considered basic human beings here, we are not allowed to work ,may of us experience difficulty in getting a drivers license, we cannot have an independent bank account- literally we are considered as without life. I do wish I came in here illegally, at least i see hope for illegals in these bills - what do H4 Visa holders have to wait for !!!
Hello ,
yesterday i was watching Cspan 2 and debate about immigration.one of the senator (i don't remember the name ) was telling about a story of a woman with six children migrated from some poor european country ten years back to America.unfortunately her husband died after coming here. She move on in life and went to idhao and opened a cattle ranch and brought up her children well. Now she is very proud and successfull business woman and mother of six grown ups whom i am sure will be well establish them selves.
i listened the story and thanked the God that she didn't came on H4 VISA.otherwise she couldn't achieve the same.
For H4 this land is certainly not land of opportunity.Rather i suggest all H4 including my wife to burn their masters in business administration degrees and PHDs ,start doing cleaning jobs like illegals and eventually apply for Z visa.
Nobody is listening to us on capital hill .H4 are inanimate objects who came here to USA to accompany their fellow husbands or wife.No matter if it is for one year or 30 years.
And in the end no reform for H4 in this bill and no hopes for getting GC to their spouse.

Guys
During 2000/01/02 around 300,000 Desis entered the country.
This is the reason for oversubscription........and FIFO is working out here.
EB2 will soon follow EB3. If you planning to change to EB2....you are inviting further delays.
Let us hang on to our EADs....this is equally well as GC....

My kids didn' go to day care until they are 1.5 years old, then they want to babysitter , they started going to day care after 2.5 years. Day care is right place for kids after 2 years, because they need other kids to play, staying home is boring for them. I have personally experienced this.
Great memory! You remember your age 2 experience!!
No wonder why you're so successful!! ;)
