Look at this thread...He got the RFE on I-140(NSC) in august and the I-140 approved in sept. You never know with USCIS..I know few guys who got lucky with their I-140s. i don't think he was planning to play with our feelings since septemebr...Do you?

1) He is claiming labor filed in Feb 06 and he got approval in May 06 (As per
his signature). Now if his file is in BEC this would not have happened so it is
safe to assume that either he might have used substitution labor OR his file
is filed in PERM. Now Feb 06 was the initial stage of PERM and during that
period there were lot many software glitches in the PERM system so many
lawyers were almost hesitant to file under PERM. But assuming that his
lawyer took decision to file under PERM, end to end process was almost 4
months for PERM so either his file was reached before Feb 06 then only he
could have labor approval in May 06. So there is definately something
wrong there.
2) If my labor is approved in May 06 why would I wait to file I-140 till Feb 07
(His signature)?
Now 1st point, considering Shimul lucky even that time one can assume it might have happened. For second point one can assume any reason for that long wait so it is not necessary that by looking to these both points we can fairly say that s/he is not representing the fact. Looks like 25% of those still waiting are in 2005 - this blows away the earlier predictions that the dates will advance quickly through 2005 - looks like pre perm cases are considerable! I was hoping that it would reach my PD atleast in Sep 2010, but now, it looks only 50-50 chance (dont ask me how i arrived at the 50-50 number, just pulled some numbers from the air :) )!

How are you trying to locate your record? Do you have your case number handy? Employer details, priority date - all that helped me find mine (rather helped me narrow it down).
I downloaded the 2004 file as you said and searched it, but could not find any information about my labor. Do you think the labor apps processed by backlog centers are in a separate file???

And you are defending a guy who has committed shop-lifting with this? You should have probably come out with more ammunition than this. Because of ppl like the OP and maybe you, we Indians are getting a really bad rep everywhere. If these are the only 2 options, I would be content with a shop lifter. Would you choose a 'prostitute' because there are no criminal issues involved and you will get your greencard faster?

AT JFK.
Submitted two copies of AP and passport. I had three copies from USCIS.
Went through US citizen/resident queue and the CBP officer took me to another verification counter.
There were only one other person (Russian). No questions asked. NONE. Verified address and very very informative and friendly CBP officer. Handed both AP with one of them stamped. I have all three copies of AP with me with one stamped.
He advised that every time I travel make sure there is no NOID on my case and my AP is current.

What Raj is saying is get your GC first and process your wife's through family based which would take a very loong time...10 years!!!
Now to my views..Your wife will be able to piggyback on your 485 application irrespective of her status H1-B or H-4 or F-1..She's your wife PERIOD...no problems there!!what i don't understand is this bangwagon "lets apply ours first and include our wife's petition later when PD becomes current"...Instead y not apply both petitions together when PD becomes current again!!Atleast you wouldn't have to worry what if my petition gets approved b4 my PD becomes current!!!And god knows how many years of H1-B extensions they would give you once you have your applied 485 receipt!!!At the end of the day it is your choice!!!

I asked my attorney he said that I need to wait at least 1 more year. The Nov and Dec are gone in holidays. These Gov emp are worst then Indian Gov Emp.

o.k...I hope you are correct. but how do you explain this ..my friend with a PD in 2004 EB3 had submitted incomplete medicals for his wife as they were expecting a addition in the family ..they submitted during the fiasco with RD in july / aug 2007 ..however no RFE's so far ?? (TSC shows processing dates in end aug 2007 ..which could mean that they are processing sept cases )

I and my wife are debating whether to apply OCI or PIO card for our son who was born in US and has a US passport. We both hold Indian passport.

I wish they do the horizontal spill from other countries to India every quarter. This way the work load at the USCIS is steady. Instead they like to wait for the last 3 months. This does not give them enough time to process.

Which service center processed your I-140 ? For Eb2 cases, USCIS ( especially NSC) doesn't accept a combination of degree and experience. They require a single 4 year degree.
You should not completely give up on this. Get a good lawyer, a good education evaluator and try to save the case.
