We applied for my wife EAD/AP on June 7, 2010 (E-file)
Her EAD was approved in few weeks back but there is nothing on her AP.
Her LUD change was on 6/11/2010 when they issued the receipt.
We called USCIS and initiated SR. Still no change in LUD.
Infopass is not a great option for us (3 hour drive one way). Any help is appriciated.
(We used to have POJ trick for calling NSC IO directly,
Does it still work?
If yes, what are the steps?)
Thanks in advance.

All,
IV supports AILF efforts to file the lawsuit and feels that if the lawsuit has a favourable judgement then, it will provide respite to lot of people in the Community IV represents. IV is not an organization which works with one motive and that is to get people out of the greencard mess and IV will support whoever helps its member community.
We feel that revision of Visa bulletin was not correct and AILF is absolutely correct to file a lawsuit against this directive and hence we support AILF in their bid to sue USCIS & DOS

After having gone through so much, it does no affect me on if the bill passes or fails. If I get GC or not, if I get EAD or not,, I have become a kind of what do you call, a stithapragna as read by Geetha.

AFAIK, AP is considered only for emergency travel. That said, I think the officer was being over reactive.
As we all know, immigration laws are arcane. AP for emergency travel was ok when people used to get GC within 6 months of 485 filing. Now, when it can take anywhere from 1 to 3 years to get GC after 485 filing, does it make sense to have AP for only emergency?! Crap...

Friends
I filed My concurrent I-140 and I-485 in Schedule A Group-II , EB-2, Exceptional Ability in Arts and Sciences Application with USCIS recipt date of AUGUST 24, 2006 for both I-140 and I-485?
(1) My I-140 is yet not approved I had asked my attorney to do premium processing. In this new situation should I go for premium processing or hold it back as they will not process my I-485 due to un availability of numbers in Schedule A.
(2)With current retrogession in Schedule A in November visa bulletin What will happen to my I-140 and I-485 processing.
(3)If Schedule A categorey ends after 10/5/2005 as indicated in November visa bulletin what will happen to CASES like mine which were filed after that? does they get transfered to EB-2 ( or EB-3) with their filing dates, set as priority date?
(4) Does establishment of date of 10/5/2005 in NOVEMBER visa bulletin means that they will still process application that they accepted till this NOVEMBER-2006 .
Your experienced help is Gretaly appreciated in this developing situation.

except for the corrupt system in india, things are pretty much the same weather US or India. After all India is our country and we must not blame for each small things. If all start thinking like this then our country will never progress.
We need to see what our country lacks and to bring them up to speed. This is been done in the past and thats why we see our country is progressing in all ways.
Wether we are here in US or india , we must never forget the things we learnt in our home country after all we are calling ourselves High tech skilled professionals.

1) should I invoke Ac 21 ??-- I am worried that the EVL may not meet USCIS needs as it may not be fully detailed
2) The other option I have is to take a leave of absence from my present company for one year and start working for the new company? IN this case what happens if I get RFE for EVL ? Which company should I say I am working for present or the future ? Also If I do take a leave of absence should I send in AC 21 paperwork or no?
PLEASE HELP I am very confused--- I strongly feel that the leave of absence might be an insurance policy but I don't know how to approach it !!
There is no such thing as "invoking" AC21. Its a law. Most important thing is, your I-140 must have been approved and I-485 is pending for more then 180 days....you are Free to sail in the same or similar field.
Forget about option 2.

Yes, they know what they do as far as globalization is concerned.
IT and BPO outsourcing is also leading to Americanization of Indian youth and Indian youth are spending their high salaries on American products. In no time you will see American fast food chains, groceries, and many American MNCs cashing on a Americanized Indian crowd and neutralize ( and will eventually exceed the investments they make).
This is the beginning of Americanization. Most of you will not understand what I say because you are here in US for a long time and being first generation immigrants (on a limbo) keep up with your tradition. Americanization is like a slow bleed. IT and BPO is investment. Returns will come in form of MNCs and businesses and finally benefit American economy.
Just go back to India and look into the ITand BPO companies and lifestyles of people there. it will be 5 times higher than what we follow here as the Americanization is already induced.
Bottomline, do not underestimate America. They know what they do.

Hi desi3933,
My wife got approval notice from 10/01/2006. Her employer is willing to give paystubs from March 2007. Will this put her back in status so that she can file I-485?
We are planning to resign after she file I-485 at July end and apply for COS with 2 paystubs. Will this cause a problem or is it legal?
Could you please advice?
Thanks
I read from a different post that you can file for AOS if you are out of status for less than 180 days. there is a section 245(k) which allows you to do this. I don't know the accuracy of this info.
this is from murthy.com site
Section 245(k) enables a person who is adjusting status in an employment-based category (whether on the basis of a labor certification or in one of the special Green Card categories that does not require a labor certification or job offer) to adjust, even if s/he has been out of status or worked without authorization for less than 180 days. This provision does not require an immigrant petition or labor certification to have been filed on or before any particular date and there is also no penalty fee involved.

The whole Insurance investment depends on the persons needs and investment capability. If you are market savvy you would take a term policy for the insurance and invest the difference between the term life policy and whole life policy premium and get a better return when compared to a whole life that on average has given a return of 8-12%pa.
That apart Prudential has a term life policy where you get back the complete premium paid under this policy at the end of the term. say for a 30 year term you paid a total premium of 30K in 30 years,, at the end of 30 years if you are still alive you will get back the 30K.. and if you are still healthy and need a policy at that time you can buy a whole life policy with this 30K which approximately will cover you for about 120K -150K assuming you are about 65 at that time..

I live in Tx..If I file today...would it help if it reaches tommorrow....for PP-I140??...Where is tjhe form for applying PP-I-140...somebody plz answer....
I believe you can e-file form I-907. I am trying like mad to get the attorney to call me back.
Does anyone know if there is a problem with the employer directly filing for premium processing bypassing the lawyer?

Then why do you want to stay here. Just move out.

I received my EAD last month. But no AP yet. However, i received an email from my lawyer today that.....my AP got rejected. The rejection letter is saying that I485 got approved that's why the I131 is rejected.....therefore, my lawyer is waiting for the I485 approval.....but my lawyer told me that I can expect my card soon.
I don't know how to react. The online doesn't have any update about the I485 status yet. They received my application on July 2, 2007.
I am sorry if you have answered this question before. Did you made a phone call to USCIS and tried to get update on your case from IO instead of relying on your Attorney ?
