I know you didn't advise me/anyone - I too expressed my view.
I still do NOT understand how a USCIS error can prevent me from re-applying !! There was a Post yesterday at IV by a gentleman from IOWA who called Up USCIS and they confirmed that it will be accepted. I PM'ed him because i was not sure if IOWA allows you to Voice-record "evidence" - He told me that USCIS recorded the call as a general Practice.
I doubt they will release their own recording to be used against them and also they says we "may" record for "Training and Quality" purpose.The best Option would be if we take Permission from the CSR and record that conversation at our end - I can't do that because the STATE i live dont allow that.
I am not advising anyone anything, I just shared what I did. This time , I did not go through a lawyer.
Something similar happened in Oct'05 and the priority dates remain retrogressed for next almost two year. It was just by stroke of fate it became current now , otherwise the situtation would have persisted.
If my memory serve me right, there were some cases back in Oct'05 whose application were rejected in error but were not allow to refile as PD had retrogressed.

Pune, India in 1996, i just filled out a form, attached a no objection certificate from my company and got a check in 2 weeks. I did not have to pay a dime, i wasnt asked any. I guess it was probably because i was in no rush to get the money.
I try not to pay out money in india, it takes time to get things done, but they do get done...maybe things have changed alot since, but i hope it should not be that bad.
I do not know in which city of India you took out your PPF.,
But I heard you have to pay atleast 5% to get PPF back in Hyd.,
Hope corruption will not be that high by next 20 years in India!!

I think desi3933 is correct. It is the employees responsibility to maintain the status and all the employee can do is to sue the employer for the pay. Even I am not sure about 30 day rule, but employee should be getting payed on H1B. Also it may only be necessary to prove the legal status since the last entry.

I was born and lived in Canada for 35 yars - I know what I am talking about.
First of all - people on umemployment insurance in Canada are counted in the unemployment rate - where ever you got your information from is wrong.
Second - yes there is racism, I am very sad to say, but I can assure you, that "for the most part", it pales in comparison to any spot in the USA.
Third - Health Care is not "Free" - you pay higher taxes there, and the government puts it back into the people (vs military in USA). You will not go bankrupt and loose your house if you (or your kids) get sick.
Fourth - You can live a great comfortable life in Canada. As someone else said, it ranks between 1 & 3 usually every year when the US rates countries based on healthcare, education, standard of living, ...
Fifth - My brother in law is a Neurologist from Mexico (married my sister), yes he worked for less than Canadian Dr.'s pay rate - BUT, his qualifications where not up to Canadian standards. He worked hard for many years to pass Canadian standard tests. Unfortunaely (or fortunately), OVERALL, Canadian standards are much higher than anything in the USA. We do not have half baked "colleges" where people who can not find their way out of a paper bag graduate from. You must pass these standards/tests/etc...
Sixth - the overall education level in Canada is much higher than in the USA. We do not have the "ghettos" as in the USA. High school graduation is the norm, not the exception.

OK - why am I going through US immigration if I love my home - W E A T H E R. I hate the cold - I now live in the LA area. Also, I belive if you have the correct skills, you can live a higher standard of living in the USA, if you measure in terms of materialistic goods only, and are imployed with benefits to ensure you are taken care of if you get sick.
Conclusion - Canada is a beautiful country. I would encourage all highly educated, good people from anywhere in the world to move there.
PS - be very careful of "false" info. E.G. - George W. Bush talked about the Canadian pharmacies supplying drugs to Americans. At one point he said that "we don't know how safe" the drugs are. Then, a few months later when flu shots were in short supply, he said " we'll get it from Canada".

And then Jim Volpe will post on website "Canada has unemployment rate of 5-6%".
Anyways, if you want to immigrate to a country, you want to go where there is low unemployment. That is the biggest criteria for choice. USA's system HAS HUGE FLAWS. The employer petition-system creates a breeding ground for exploitation and the numerical cap is too low that results in delays that are unbearable. And yes, the DOL has come really close to making people commit suicide because of labor backlogs. But then, only the employer petition system can actually give greencards to THOSE WHO CAN SURVIVE and get jobs in the economy and not give greencards just because they scored points.
I know I will receive a lot of flak as I have before, and I wish there was points based system here in USA too with self-petition option like Canada, but trust me, if that happens, then this country will be full of people with greatest points,(obtained thru fake degrees and Ph.Ds from the whole world) and really really make the nightmares of NumbersUSA and FAIR become true, and it wont be worth living.

International students come on F1 visa and get instate tuition fee from state universities. Our kids are on H4s so that will not qualify them to attend undergraduate in state schools? Is F1 required to get instate tuition fee? I am not understanding the situation here. Please somebody clarify if possible.
F-1 students do not enjoy any more privileges than H-4 applicants. In fact, you may like to check with the university authorities, for H-4 students pay in-state tuition if other requirements are fulfilled. Things like residency for a period of time, employment of guardians, etc.
To my knowledge, F-1 students do not qualify for in-state tuition at all. They can apply for a minuscule number of tuition waivers on grounds of economic hardship, academic performance and the like. However, the situation may vary from univ to univ and state to state. My knowledge is limited to Georgia, and specifically Georgia Tech, GSU and UGA

this could be read 2 ways...either you need have an approved I-140 prior to filing for portability OR the adjudicator needs to approve the I-140 prior to determining portability.
I had asked TWO different lawyers and they were BOTH 100% sure that to use the AC-21 you needed an APPROVED I-140 not an approvable I-140.

You are the first guy who wrote a sensible post regarding CIR. Most if not all people here are delusional when it comes to CIR. I don’t trust Obama and Durbin to do any justice for Eb immigrants. The democrats agenda was always the illegals, as far as we EB are concerned they would prefer that we just get kicked out through endless RFE harassment from USCIS. The fact is republicans don’t like non whites to immigrate to US and the democrats are color blind to most extent but they are class conscious, they like illegals and poor people to immigrate to US because they can control them whereas they cannot control and herd the EB immigrants. So when the negotiations for CIR start Republicans will oppose any immigration so the democrats will strike a bargain with the republicans where they will ask for amnesty for illegals and in return they will happily throw the EB community under the bus by saying they are "reforming" the US immigration system by introducing a points based system where even existing applicants like the EB folks who have been in US for the last 10+ years have to re apply in points based nonsense system. Before people get angry ask yourself this question
1. Was there a visa recapture in the last CIR (don’t confuse with the first CIR which was passed by Arlen Specter which was the best CIR, it had visa recapture, it had STEM exemption)
2. Did it have Stem exemption i.e. exempt people who earned a Master and PHD from American universities from yearly green card quota?
3. Did it eliminate country quota.
4. Did it at least give an amnesty\interim type green card deal to honest legal EB folks like they gave to illegals?
The unfortunate answer to all those is a "NO" and this was when the president was Bush a republican, now you have Obama as the president and Durbin as his right man in senate. Does anybody really expect Justice for EB from these two?

India has PPF/PF and that money will go in you PPF/PF account, its not a black hole, infact it pays the highest interest and its secure. its very easy to get money out of your PF account. i took it out of my PPF account before i came to the US and promptly spent all :)
its another topic that SS repatriation will never be approved, especially retroactively.
Yeah I get that the money will be transferred from the Social security system here to the Indian Govt system.
My point is it does not do a damn thing for us workers personally. That money will dissapear into a dark hole in the Indian Gov't coffers instead of a dark hole here, further as the rules stand, I have a slim chance of getting the money from here through social security payments when I turn 65 even if I am in India. Try that within the money in Indian gov't hands.
On the other hand, it makes the Indian gov't allign with corporate america, as they all have a vested interest in a Temp. worker program such as H1b absent green cards. Which will be a win win for all concerned except us.
